Terms of Service

These Terms of Service ("Terms") govern your use of the website and services (the "Service") operated by 3RDROCK.DEV ("HuntingNotHunting," "we," "us"). By using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. What HuntingNotHunting is
HuntingNotHunting is a marketplace that connects businesses that post bounties for qualified sales meetings with independent callers ("callers" or "reps") who compete to book them. HuntingNotHunting provides the platform; it is not a party to the underlying sales relationship, is not the employer of callers, and does not guarantee that any meeting will be booked or will convert.
2. Eligibility & accounts
- You must be at least 18 years old and able to form a binding contract.
- You are responsible for the accuracy of the information you provide and for activity under your account.
- You must keep your login credentials secure and notify us of any unauthorized use.
3. For businesses
- You define your target buyer, your qualification bar, and the bounty amount for each qualified meeting.
- You review and approve which callers may dial on your behalf.
- A bounty is earned when a meeting is booked that meets the qualification bar you set. A meeting that does not meet that bar does not earn the bounty.
- You authorize us to charge the bounty and the applicable platform fee when a qualifying meeting books.
- You are responsible for any lead lists you provide and for having the right to use them.
4. For callers
- Callers are independent contractors, not employees of HuntingNotHunting or of any business. Nothing here creates an employment, partnership, or agency relationship.
- You are responsible for your own taxes; payouts are reported as applicable (for example, on a 1099 in the U.S.).
- You agree to work approved bounties in line with the business's script and requirements, and to conduct yourself professionally and lawfully.
- Earned bounties are paid out through our payment processor on the schedule described at sign-up (for example, weekly via Stripe).
5. Payments & fees
Payments and payouts are processed by Stripe under its own terms. HuntingNotHunting charges businesses a platform fee of [__]% on each booked qualified meeting. Fees and bounties are charged only when a qualifying meeting books. Except as required by law or expressly stated, amounts paid are non-refundable. Disputes about whether a meeting qualified are handled under our then-current dispute process.
6. Compliance with calling & marketing laws
You are solely responsible for complying with all laws that apply to your outreach, including telemarketing, do-not-call, consent, and call-recording laws (for example, in the U.S., the TCPA and applicable state and federal Do-Not-Call rules). You must not use the Service to contact people you are not permitted to contact, or to make unlawful or deceptive calls.
7. Acceptable use
You agree not to:
- Use the Service for any unlawful, harassing, deceptive, or fraudulent purpose.
- Misrepresent who you are or who you represent.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.
- Scrape, resell, or misuse data obtained through the Service.
8. Intellectual property
The Service, including its content and branding, is owned by HuntingNotHunting or its licensors and is protected by law. We grant you a limited, revocable, non-exclusive license to use the Service as intended. You retain rights to content you submit and grant us the rights needed to operate the Service.
9. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any particular outcome (such as a booked or converted meeting) will result.
10. Limitation of liability
To the fullest extent permitted by law, HuntingNotHunting will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Service will not exceed the greater of [amount, e.g., $100] or the fees you paid to us in the [3] months before the claim.
11. Indemnification
You agree to indemnify and hold HuntingNotHunting harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your content or lists, your calls, or your violation of these Terms or applicable law.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. Provisions that by their nature should survive termination will survive.
13. Governing law & disputes
